Divorce registration in Saudi Arabia: the 15-day deadline, Najiz steps, the divorce document, and the wife's right to prove an undocumented divorce.
Short answer: Talaq is the dissolution of a marriage by the husband’s will. He must document it with the competent authority within 15 days of the separation, using Najiz’s Divorce Documentation service. If he does not, the wife may file a claim to prove the divorce and may seek compensation if she did not know about it.
This guide explains talaq registration and rules on iddah, custody, maintenance and dowry, using the statute and Najiz procedures. For disputes, see Kawkaba’s family law service.
What is talaq, and how does it take effect?
Article 77 of the Personal Status Law defines talaq as dissolution by the husband’s will using words that express it. Articles 78 and 79 cover explicit and intended implicit wording, spoken, written or communicated by understandable gesture when necessary.
Article 80 excludes cases including lack of reason or free choice, anger preventing control over speech, and divorce during menstruation, postnatal bleeding or a period of purity in which intercourse occurred, where the husband knew the wife’s condition. Repeated or numbered pronouncements in one sitting count as one talaq (Article 83).
Revocable and irrevocable talaq
Type Effect on the marriage How the spouses may reunite Revocable (raj‘i) Ends only when iddah expires Revocation before iddah ends Minor irrevocable (bainunah sughra) Ends when talaq occurs New contract and dowry, with previous talaqs counted Major irrevocable (bainunah kubra) The third talaq ends the contract The conditions in Article 85 apply
Talaq is generally revocable except for the third talaq and talaq before consummation or valid seclusion (Articles 85–86). Article 87 preserves revocation during iddah even if waived; Article 92 regulates its documentation.
How do you register a divorce through Najiz?
The Ministry of Justice’s Divorce Documentation service covers previous and new divorces after the required procedures and approvals:
Sign in to Najiz through National Access (Nafath).
Select All E-Services, then Social Status.
Open Divorce Documentation and click Start Service.
Enter applicant and party details, marriage contract or family register details, divorce details and place of occurrence.
Attach the required documents and submit.
Receive a text message with the application number and date.
An agent needs a valid power of attorney. Foreign-issued documents must be certified by the Ministries of Justice and Foreign Affairs. Supporting documents may be requested. The page lists two days for service completion through Najiz or a Najiz centre, not for a disputed court claim.
When must divorce be registered, and what follows delay?
Article 90 gives the husband 15 days from the separation, not 30 days, to document talaq. It preserves the wife’s right to prove the divorce in court.
If he fails and she did not know, Article 91 gives her compensation of at least the minimum maintenance amount from talaq until she learned of it. Illustrative example: if she proves the divorce, her lack of knowledge and the dates, compensation covers that same period.
For a documented revocable divorce, Article 92 requires revocation to be documented within 15 days of its date. Without documentation or the wife’s knowledge, revocation is invalid where she has since married another man. She may also claim maintenance for the previous period.
How do you obtain a divorce deed or document?
These phrases describe the official record proving talaq. The published service is Divorce Documentation, covering previous and new divorces.
Submit the actual divorce details and place of occurrence, attach the requested documents and retain the application number. Follow the status and Najiz notifications until registration is issued.
How can a wife prove an undocumented divorce?
Article 90 places registration on the husband and gives the wife an independent right to file a claim to prove talaq. The claim establishes a divorce already pronounced, and Article 93 requires evidence for her assertion.
Gather evidence such as relevant writing from the husband, and use Najiz’s Statement of Claim service:
Sign in with Nafath.
Select All E-Services, then Judiciary.
Open Statement of Claim and choose New Application.
Enter the claim category and review its requirements.
Enter claim and party details, attach documents and submit.
The defendant’s identity must be known. A court visit is required only if requested by text message. The court assesses the evidence.
What claim can a wife bring to end or prove a marriage separation?
Proof of talaq: establishes a divorce already pronounced but not documented, using evidence.
Khula: requested by the wife and accepted by the husband for compensation under Article 95. See Khula in Saudi law.
Faskh: a court claim on a statutory ground, such as harm preventing married life or non-payment of maintenance. Read Marriage annulment in Saudi Arabia.
How is iddah calculated after divorce?
Article 116 defines iddah as the period during which a woman may not remarry following separation. For separation other than death, it applies after consummation or valid seclusion in a valid marriage (Article 117).
Iddah starts when talaq occurs (Article 118). Where disputed talaq is later established in court, it starts on the date the court establishes it. Remarriage follows the end of iddah or the judgment becoming final, whichever is later.
Article 121 provides three menstrual cycles, or three months for a woman who has reached menopause or has not menstruated. If the latter menstruates before the three months end, iddah restarts using cycles. Iddah ends with delivery where pregnancy has exceeded 80 days (Article 120).
What happens to custody, maintenance and dowry?
Custody: Article 127 starts with the mother, then the father, maternal grandmother and paternal grandmother, subject to the child’s interest. See Child custody after divorce.
Maintenance during iddah: it is due after revocable talaq until iddah ends. After irrevocable talaq, it is due only during pregnancy until delivery (Article 53). Read Nafaqa in Saudi law.
Dowry: consummation, valid seclusion or either spouse’s death confirms the full named or customary dowry. Divorce before consummation entitles the wife to half the named dowry or, if none was named, a gift capped at half the customary dowry (Article 40).
Is reconciliation required before registration?
The published Divorce Documentation steps do not include reconciliation. Spouses seeking help may use the Ministry of Justice’s Taradhi platform. A disputed claim to prove talaq still follows the court process.
Frequently asked questions
How long does the husband have to register talaq?
Fifteen days from the separation under Article 90. Najiz separately lists two days for completion of the documentation service; that is not the statutory deadline.
Does talaq take effect before registration?
It can take effect under Articles 77–79, subject to Article 80. Registration is mandatory for official proof, and failure to register does not remove the wife’s right to prove it in court.
How do I get a divorce document from Najiz?
Start with Divorce Documentation in the Social Status package, enter the details, attach documents and submit. Track the application and notifications until registration is complete for a previous or new divorce.
Can a wife register or prove talaq?
Article 90 places the registration duty on the husband. The wife may file a claim to prove an undocumented talaq, with evidence required under Article 93, through Statement of Claim to the personal status court.
What if the husband did not register and the wife did not know?
Article 91 entitles her to compensation of at least the minimum maintenance amount from talaq until she learned of it. She must establish the divorce, knowledge date and supporting facts.
Do three pronouncements in one sitting count as three divorces?
No. Numbered or repeated talaq in one sitting counts as one talaq under Article 83.
When does iddah end?
Article 121 specifies three menstrual cycles or three months for a woman who is not pregnant. For a pregnancy exceeding 80 days, iddah ends with delivery. Its start depends on whether talaq occurred directly or was disputed and established in court.
