The path of a criminal case, from summons to objection

  1. 1Summons or arrest: we hear the circumstances, establish the capacity in which you are summoned and the likely charge, and arrange your attendance or follow the detainee's situation.
  2. 2Investigation at the Public Prosecution: we attend questioning where the law allows, review whatever papers are made available, and submit requests and defences in writing.
  3. 3Trial before the criminal court: we answer the public prosecution's statement of charges, challenge the evidence and witnesses, and file a defence memo at each hearing.
  4. 4Objection to the judgment: we study the ruling and its reasoning, and prepare the objection to the Court of Appeal before the statutory period runs out.

What Kawkaba's team brings to a criminal defence

Confidential from the first call

What you tell us about the matter is protected by professional secrecy and is used only to build your defence, with your consent.

Present at the investigation stage

We give particular weight to the investigation stage at the Public Prosecution, because what is recorded in the questioning transcript is hard to undo later before the criminal court.

A candid reading of your position

We tell you plainly where the prosecution's evidence is strong and where it is weak, and we record the scope of representation and the fees in a written agreement, without promising any particular verdict.

A Public Prosecution summons: what to do before you attend

A summons from the Public Prosecution usually arrives by text message or another official channel, and sets a date and place to attend. You may be summoned as a witness, as the person who reported the matter, or as a suspect, and the difference between these capacities matters greatly for what follows from your statements. Do not ignore the summons: failing to attend without an acceptable excuse may lead the investigating authority to order that you be brought in, leaving you in a harder position than necessary.

The Law of Criminal Procedure secures for the accused the right to seek the help of a lawyer in both the investigation and trial stages. In practice this means contacting a lawyer before the appointment, not after it: we ask for the case number and the summoning authority, go through what happened in order with you, and accompany you to questioning where the authority permits. Read the record of your statement in full before signing it, and ask for any wording that does not reflect what you said to be corrected.

Take with you to the appointment:

  • A copy of the summons message or the case number, if any
  • A valid national ID or residence permit
  • Any documents or messages connected with the matter in question
  • A power of attorney allowing your lawyer to follow and review the file

Investigation, detention and release: how a criminal case moves

A criminal case in Saudi Arabia moves through successive stages: evidence gathering by criminal investigation officers, then the investigation conducted by the Public Prosecution, then the prosecution itself, when the case is referred to the criminal court with a statement of public charges, and finally the trial. Each stage has its own safeguards: arrest, search and detention are permitted only in the circumstances and under the conditions the law sets out.

If a relative has been detained, the first thing you need is to know which authority is holding them and why. Once the proper power of attorney is in place, one of our licensed lawyers can follow the file with the Public Prosecution, check that the arrest procedures were lawful, and submit a release request when the grounds exist, which may require bail or a surety. The decision rests with the investigating authority or the court; our role is to put the request forward on time with its full legal grounds.

The hours after a summons or arrest are when statements are recorded and evidence is collected, and what is written then stays with the case until its end. Do not wait for the hearing date to act.

Drug case lawyer: defence under the Narcotics and Psychotropic Substances Control Law

Drug cases are among the criminal matters with the heaviest impact on the accused and their family, and they are governed by the Narcotics and Psychotropic Substances Control Law and its implementing regulations. The law itself distinguishes between different forms of conduct: use, possession for personal use, possession or transport for distribution, and smuggling. Each carries a different legal description and penalty, so the defence starts with one question: what is the correct description of what happened?

A drug case lawyer examines the file procedurally before its merits: were the arrest and search carried out as the law requires? Were the seized items sealed and their handover from one authority to another documented? Does the laboratory report match what was actually seized? Do the papers prove an intent to distribute, or is that only an inference from the quantity? These questions are not about escaping accountability; they are about holding a person to account only for what is proven, through the correct procedures.

A criminal defence lawyer from our team attends the investigation and hearings, presents the accused's personal circumstances and record, and raises any special provisions the law may allow in certain cases, such as those concerning a person who comes forward voluntarily to seek treatment.

Forgery, fraud and cybercrime: cases built on documents and digital evidence

Forgery of documents, seals and signatures is dealt with under the Penal Law on Forgery Crimes, while the Law on Combating Financial Fraud and Breach of Trust covers taking another person's money by fraudulent means, or disposing of entrusted money in a way that contradicts the purpose for which it was handed over. Acts committed through networks or devices, such as unlawful access, extortion and defamation, fall under the Anti-Cybercrime Law.

These cases usually rest on documents, bank transfers and electronic messages, so the defence turns on specific questions: who created the document and who used it? Was there criminal intent, or is the dispute really a civil or commercial one dressed up as a crime? Are the handwriting or technical examination reports sound? We review every paper in the file, request the appointment of an expert when needed, and separate a mistake in dealings from a criminal act.

If you are the one who was defrauded or whose documents were forged, we help you file a clear report backed by evidence, then claim your private right, recover what money can be recovered, and seek compensation for the harm.

Criminal appeals and objecting to a judgment

A judgment from the criminal court is not necessarily the end of the case. The Law of Criminal Procedure allows the convicted person, the Public Prosecution and the holder of a private right to object to the judgment before the Court of Appeal within a statutory period counted from the date the copy of the judgment is received. If that period passes without an objection, the judgment becomes final, which is why we ask you to send the judgment as soon as you receive it rather than after days of hesitation.

An objection is built on specific grounds: an error in applying or interpreting the law, insufficient reasoning, failure to address a material defence raised at the hearings, or a penalty out of proportion to the proven facts. One of our licensed lawyers reviews the hearing records and the reasoning of the judgment point by point before drafting the objection. After the appeal, the path may extend to an objection before the Supreme Court where the law permits it, or to a petition for reconsideration if new facts or documents come to light.

Frequently asked questions

What should I do if I receive a summons from the Public Prosecution?

Attend on the date and do not ignore the message, and speak to a lawyer before you go. We help you find out, as far as possible, the capacity in which you are summoned and what it concerns, go over the facts so you give your statement calmly and accurately, and accompany you where the authority allows.

Am I entitled to have a lawyer with me during questioning?

Yes. The Law of Criminal Procedure gives the accused the right to be assisted by a representative or lawyer in both the investigation and trial stages. Attendance arrangements can vary with the type of case and the stage, so we ask for the lawyer's presence to be formally recorded in the file from the outset.

How do I request the release of a detained relative?

A release request goes to the investigating authority or the court, depending on the stage of the case, and rests on the nature of the charge, the detainee's circumstances and assurances that they will attend. One of our lawyers follows the request once authorised and explains to the family what may be asked of them, such as bail if required.

What is the difference between use, possession and distribution in drug cases?

The Narcotics and Psychotropic Substances Control Law treats these acts differently in both description and penalty. Use is personal consumption, while possession may be for personal use or for distribution, with intent inferred from the quantity, the circumstances and the evidence. Establishing the correct description is one of the central points of the defence.

What is the deadline to object to a criminal judgment?

The Law of Criminal Procedure sets the objection period, counted from the date the copy of the judgment is received, and missing it ends your right to appeal and makes the judgment final. Send a copy of the judgment and the date you received it straight away, so we can calculate the deadline precisely and start preparing the objection.

Do you handle criminal cases outside Jeddah?

Yes. Our office is in Jeddah and we follow files across Saudi Arabia: many procedures are handled online via Najiz, some courts hold video hearings, and we travel to attend in person when the case calls for it, particularly for investigation sessions.

How much does a criminal lawyer charge?

There is no fixed figure: fees follow the seriousness of the charge and how many stages are needed, from attending the investigation alone to full trial advocacy and appeal. After hearing the facts, we propose the scope of representation and its cost in a written contract that you sign before we begin.

Can I claim compensation if I am the victim?

Yes. A victim may pursue their private right alongside the public right handled by the Public Prosecution, whether as compensation for harm or the return of money. We help you draft the report, follow it through the investigation, and then present the claim before the criminal court.
