Claim for Return of Property (Radd Al-Ayn) in Saudi Arabia

Keys and a contract on a desk, representing a claim for return of a specific asset or property

Claim for return of property in Saudi Arabia: when you can demand a specific asset held by someone else, required documents, and how it differs from a money claim.

Short answer: A return-of-property claim asks the court to order another person to return a specific asset, such as real estate, a vehicle or equipment, held under a lease, loan for use or safekeeping arrangement, or taken without right. The claimant proves their right, delivery to the holder and refusal to return it. The competent court decides the claim.

In many disputes, the claimant does not want money; they want the asset itself back: a flat whose lease has ended, a car lent to a relative, equipment delivered to a former partner, or jewellery left in someone's safekeeping. This type of request is known in judicial practice as radd al-ayn, a claim for return of the specific thing.

This guide explains what that means, when such a claim is used and which documents help. For an existing dispute, see our property and asset recovery lawyer service.

What is the “specific thing” being claimed?

It is an asset identified by its own identity rather than an interchangeable sum: property identified by its deed and location, a car identified by its plate and chassis, or equipment identified by a serial number. This distinguishes it from a monetary debt that can be discharged with an equivalent payment.

The request is therefore return of the thing itself, not payment. If your request is only for money, a financial claim is generally the relevant type of action.

When is a return-of-property claim used?

After a lease ends

If the lease expires and the tenant refuses to hand over the leased property or movable asset, the lessor may request its return. See our separate guide to property eviction.

Loan for use and safekeeping

If you lend an item for use or deposit it for safekeeping and the holder refuses to return it on request, you may claim its return.

After rescission or invalidity of a contract

Rescission or invalidity of a sale may require each party to return what it received: the seller seeks the sold asset and the buyer seeks the price.

What documents help?

The claim focuses on three points: your right in the asset, its possession by the defendant, and refusal to return it. Useful evidence includes:

  • A property title deed, vehicle registration or purchase invoice.

  • The contract under which the asset was delivered, such as a lease, loan for use, safekeeping or partnership agreement.

  • Proof of delivery: a handover record, message or witnesses.

  • Proof of your demand and the refusal: a written notice or correspondence.

  • A precise description distinguishing the asset.

  • A valid power of attorney if a lawyer files on your behalf.

How do you file the claim?

  1. Check the appropriate route: determine whether you already hold an enforceable instrument or need a judgment.

  2. Prepare the statement of claim: describe the asset, the basis of possession, the refusal and your requests. See our statement of claim guide.

  3. File electronically through Najiz and attach the evidence.

  4. Attend hearings in person or remotely, present evidence and answer defences.

  5. Enforce the judgment through the Enforcement Court if the judgment debtor does not comply voluntarily.

Pre-filing checklist

  • Describe the asset precisely.

  • Gather proof of ownership or another right in it.

  • Document why it was delivered to the other party.

  • Make a written demand and retain proof.

  • Confirm that you seek an asset, not only money.

  • Check whether you already hold an enforceable instrument.

  • Obtain an initial assessment of your position.

Frequently asked questions

How does this differ from a financial claim?

A return-of-property claim seeks a specific asset; a financial claim seeks a sum of money.

Can I file without a written contract?

Generally yes. Delivery and the claimed right may be proved by other evidence, such as correspondence and witnesses, under the Law of Evidence. A written contract usually makes proof easier.

Can the claim be handled remotely?

Claims can be filed electronically through Najiz, and many hearings are held remotely. A lawyer can act under a power of attorney.

Can I take the asset back myself?

Self-help recovery is discouraged because it may expose you to liability and weaken your position. The appropriate route is a court claim or enforcement through the court.

Need help recovering property or another asset?

A precise asset description, evidence of possession and the correct procedural route are central to these claims. Our licensed lawyers review documents and assist clients across Saudi Arabia in person and remotely. See our property disputes service or request a case assessment.
