All hours worked on rest days and holidays count as overtime

What does Article 107 of the Labor Law say?

Article 107 requires the employer to pay, for overtime hours, a wage equal to the hour's wage plus 50% of the basic wage. Under the weekly standard, hours above it are overtime, and all hours worked on rest days and holidays are overtime.

Article 108 excludes some cases from Articles 98 and 101, including senior management roles with employer-like authority, work that is intermittent by nature, and guards and cleaners other than civil security guards; the regulations define some of these jobs.

Illustrative example: actual wage SAR 6,000, basic wage SAR 4,000 with the hour's wage based on 240 hours (30 days × 8 hours). The hour's wage is SAR 25 and half the basic hourly wage is SAR 8.33, so an overtime hour is about SAR 33.33 and ten overtime hours about SAR 333.33.

FAQ

How is overtime pay calculated under Saudi Labor Law?

Article 107(1) requires the employer to pay, for each overtime hour, the hour's wage plus 50% of the basic wage. For a monthly-paid worker the hour's wage is the monthly wage divided by 30 days and then by 8 hours, that is by 240 hours, and the calculator applies this to the two wages you enter.

Do hours worked on rest days and holidays count as overtime?

Yes. Article 107(3) treats all hours worked on rest days and public holidays as overtime.

What are the normal working hours?

Article 98 caps actual work at eight hours a day under the daily standard or 48 hours a week under the weekly standard, reduced for Muslims in Ramadan to six hours a day or 36 a week.

When do hours count as overtime under the weekly standard?

Under Article 107(2), where the business uses the weekly standard, hours above that weekly standard are overtime.

What if my overtime is not paid?

Start with an amicable settlement request with the Ministry of Human Resources, then the Labor Court if the settlement does not resolve it. You can send the calculator result and your case details for review.
